Deck, business to be discussed

A deck at a residential property and further discussion of a business in the county are subjects of two public hearings for Monday’s Cumberland County Planning Commission meeting.
The owner of a residential property at Anderson Highway is requesting a conditional use permit to install a deck at the front setback of the home.
The board packet for the Monday meeting noted that the deck, as it stands, currently violates the Cumberland County Code.
The front porch extends 8 feet from the dwelling,” the board packet cited. “The setback is 130 feet from the centerline of the road, and this porch is 113 feet from the centerline. This means the current porch is encroaching into the front setback by 17 feet.”
To address violations, owners would need to apply for conditional use permits and meet the conditions in order for the violation to be lifted.
Conditions associated with the permit, according to the board packet, include not having boundary lines adjusted that cause the lot to be smaller in the future, and that the front area of the setback be 113. The rear, side yards and accessory would need to conform to the standard measurements placed by the county.
In the case that the conditional use permit is granted, the board packet cited that the county’s Building Inspections Department would need to issue permits and conduct inspections before completing a final inspection of the deck.
A second public hearing will discuss a conditional use permit for 4-Wheel Drive Specialty Conversion Division, Inc. on 1936 Cartersville Road that was carried from the commission’s March meeting. The council is set to make a recommendation during the Monday meeting.
The Cumberland County Board of Supervisors, during its May 8 meeting, voted to table action on a conditional use permit for 4-Wheel Drive Specialty Conversion Division, Inc.
The off-site collection, transportation and waste disposal business, which also performs other services, has created debate among members of the planning commission about how to rectify a violation of a prior conditional use permit for the property.
The violation concerned fencing at the business located at 1936 Cartersville Road, where hay bales are used as fencing along the roadway.
Planning and Zoning Director JP Duncan said during the May 8 meeting that the updated site plan for 4-Wheel Drive Specialty Conversion Division was not submitted by the surveyor for the property, Woodrow K. Cofer and was not available to the planning commission. Duncan noted during the board of supervisors meeting that the delay should not have an effect on the business’ current operations.
