In execution of a certain deed of trust dated November 20, 2006, in the original principal amount of $236,999.34 re-corded in the Clerk's Office, Circuit Court for Prince Edward County, Virginia, in Instrument No. 200603319, default hav-ing occurred in the payment of the Note thereby secured and at the request of the holder, the undersigned Substitute Trustee will offer for sale at public auction on the front steps of the Circuit Court for Prince Edward County, 124 North Main Street, Farmville, Virginia, on January 06, 2011, at 5:30 PM, the property described in said deed of trust, located at the above address, and more particularly described as follows: ALL THAT CERTAIN TRACT OR PARCEL OF LAND, TO-GETHER WITH IMPROVEMENTS THEREON AND APPURTENANCES THERETO ATTACHED, BELONGING, LYING AND BEING IN FARMVILLE MAGISTERIAL DISTRICT, PRINCE EDWARD COUNTY, VIRGINIA, LOACTED ON THE NORTH SIDE OF PRINCE EDWARD HIGHWAY NO. 648 LEADING FROM THE BACK HAMPDEN-SYDNEY ROAD TO THE TUGGLE ROAD AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: FACING 350 FEET ON ROUTE 648 BEGINNING AT A WHITE OAK AT THE CORNER OF WALKER R BURLEY AND JOHN J HOLSHOE; THENCE ALONG THE BUR-LEY/HOLSHOE LINE 627 FEET TO A POINT; THENCE IN AN EASTERLY DIRECTION 350 FEET ALONG THE BACK LINE RUNNING PARALLEL TO STATE ROUTE NO 648; THEN 627 FEET TO THE EDGE OF STATE ROUTE NO 648; THENCE ALONG STATE ROUTE NO 648 A DISTANCE OF 350 FEET TO THE POINT OF BEGINNING, CREATING A RECTANGULAR TRACT OF LAND (350 FEET BY 627 FEET)..TERMS OF SALE: ALL CASH. A bidder's deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject deed of trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser's deposit may be forfeited to Trustee. Time is of the essence.
