NOTICE OF SUBSTITUTE TRUSTEE'S SALE OF PROPERTY

In execution of a deed of trust recorded in the Clerk's Office of the Circuit Court for the County of Cumberland, Virginia as Instrument Number 20071459 the undersigned, Tessie O. Barnes Bacon and Frank F. Rennie, IV, Substitute Trustees, will offer for sale at public auction at the entrance of the Circuit Courthouse of the County of Cumberland on the 7th day of March, 2011 at 10:00 A.M., certain property described in said deed of trust lying in the County of Cumberland, Virginia, known as 3291 Cumberland Road, Cumberland, Virginia 23040 and more particularly described in the Deed of Trust recorded as Instrument Number 20071459 in the Circuit Court for the County of Cumberland, Virginia.

As provided in the deed of trust and pursuant to the provisions of applicable law, the undersigned Substitute Trustee may exercise all of the powers, rights, authority, and duties granted in the deed of trust.

TERMS: The terms of the sale are as follows: Cash. A 10% non-refundable deposit of the bid price in cash or cashier's check shall be tendered at the time of the sale. The deposit, if not in cash, shall be made payable to the Substitute Trustees. The remaining balance of the bid price shall be due to the Noteholder within 30 days. Closing shall occur within thirty days of the sale. Time is of the essence. If the purchaser does not remit the money to Noteholder within the requisite time period, the purchase is void. Additional terms and conditions may be announced at the sale. The property will be sold “AS IS” and will be conveyed by special warranty deed, subject to all liens, objections, rights, reservations, leases, covenants, conditions, easements, and restrictions superior to the lien of the deed of trust as they may lawfully affect the property. Neither the Substitute Trustees nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder. The purchaser at the sale will be required to pay all closing costs except the grantor's tax. Real estate ad valorem taxes will be prorated as of the date of the closing.
