Pursuant to the terms of a certain Deed of Trust, in the original principal amount of $201,000.00, dated January 27, 2011, and recorded in the Clerk's Office of the Circuit Court of Cumberland, Virginia (the “Clerk's Office”), as Instrument Number 20110365, default having been made in the payment of the note thereby secured, the undersigned Sole Acting Substitute Trustees, pursuant to the request of the holder of the Note thereby secured, will offer for sale at public auction outside of the Cumberland Circuit Court, located at 1 Courthouse Circle, Cumberland, VA 23040 on December 11, 2012 at 12:00 PM, the property briefly described as 44 Fleming Road, Cumberland, VA 23040, and more particularly described in said Deed of Trust as follows:

Cumberland County, Commonwealth of Virginia, Tract l: That certain parcel or tract of land, situate, lying and being in the Madison Magisterial District of Cumberland County, Virginia, containing one (1) acre, more or less, but conveyed by the boundary and not by the acre, about two miles west of Cumberland Courthouse on the north side of Old State Highway No. 45, fronting on said road 50 feet and running back from said road between parallel lines 50 feet apart, the western line being the line with the property of or formerly of William Brooks, also known as Willie Brooks, a distance of approximately 320 feet to a corner, thence running in a northwesterly direction 285 feet to the property line of or formerly of Joe Brooks. Tract II: All that certain parcel or tract of land situate, lying and being in the Madison Magisterial District of Cumberland County, Virginia, containing one and one-fourth (1 1/4) acres, more or less, being part of the Old Home Place of R.A. Hicks and Lou E. Hicks, fronting on the north side of Old State Highway No. 45, and more particularly described as follows: commencing 60 yards from the corner of the yard of or formerly of R.A. Hicks on said Old State Highway No. 45 and thence running 90 yards up said highway to the line of or formerly of Richard Fleming, thence running northwest 70 yards to a stone, thence running northeast 102 yards to the line of or formerly of R. A. Hicks and thence running 70 yards up to the point of beginning. Tract III: All that certain parcel or tract of land situate, lying and being in the Madison Magisterial District of Cumberland County, Virginia containing one and thirty-seven one-hundredths (1.37) acres, more or less, lying on the north and west side of the land now or formerly owned by Betty Parker, also known as Bettie Parker, and George Parker, wife and husband, and fronting on the north side of Old State Highway No. 45 adjoining property of or formerly of Richard Fleming on the west, property of or formerly of Lou E. Hicks on the north and west. This parcel of land is a part of the Old Home Place of R.A. Hicks and Lou E, Hicks and is marked by stones at each corner. Less and except: that certain lot or parcel of land containing one and fifty-eight one-hundredths (1.58) acres, more or less, situate, lying and being in the Madison Magisterial District of Cumberland County, Virginia, on the northwest side of state road no. 619, adjoining property of or formerly of Nannie Brooks, also known as Nannie Burnette brooks, on the northeast, property of or formerly of R.D. Fleming on the west and property of or formerly of Joe Brooks and Cordella Brooks, husband and wife, on the southwest, described by metes and bounds on a plat dated September 3, 1970, recorded in the Clerks Office of the Circuit Court of Cumberland County, Virginia in Deed Book 121, Page 2, with improvements thereon.

TERMS OF SALE: Cash. A ten percent (10%) bidder's deposit in cash or certified check payable to the Trustee(s) shall be required of the successful bidder at the time of sale before the bidding will be closed; settlement must be made within twenty (20) days from the date of sale or property to be resold at cost of defaulting purchaser. All costs of conveyancing, examination of title, recording charges, etc. will be at cost of purchaser. Neither the Substitute Trustees, nor any other party guarantees or covenants to deliver, or in any way, to obtain possession of the premises for any third party purchaser.
