PURPOSE OF NOTICE: To seek public comment on 1) a draft permit from the Department of Environmental Quality that will allow the release of treated wastewater into a water body in Buckingham County, Virginia and 2) a proposed modification to the completed Total Maximum Daily Load (TMDL) study for the Willis River.

FACILITY NAME AND LOCATION: Buckingham County Water System/Dillwyn STP; 338 Hancock Street, Dillwyn, VA 23936, Buckingham County

PROJECT DESCRIPTION: Buckingham County Water System has applied for reissuance of a permit for the Dillwyn Sew-age Treatment Plant (STP). The applicant proposes to release treated wastewater at a rate of 0.200 Million Gallons per Day into a water body. The facility proposes to release the treated wastewater into an unnamed tributary of the Whispering Creek, in Buckingham County in the James River watershed. A watershed is the land area drained by a river and its incoming streams. The permit will limit the following pollutants to amounts that protect water quality: pH, Oxygen Demand, Solids, E. coli, Dis-solved Oxygen, Ammonia-Nitrogen, Chlorine, hardness, copper, zinc, and nutrients. The permit conditions and effluent limita-tions and monitoring requirements are being tiered for the existing design flow of 0.100 MGD and the future design flow of 0.200 MGD.

PROJECT DESCRIPTION – WILLIS RIVER TMDL STUDY MODIFICATION: This TMDL was approved by the Envi-ronmental Protection Agency on 5/31/2002 and can be found at the following website: http://www.deq.virginia.gov/portals/0/DEQ/Water/TMDL/apptmdls/jamesrvr/willisfc.pdf. The revised TMDL will be changed to accommodate a flow discharge rate of .200 million gallons per day for the previously permitted facility, Buckingham County Water System/Dillwyn STP (VA0027294), which as a higher number reflects the correct permitted inputs into the stream. Up-dating the allocations and associated text in the Willis River bacteria TMDL will protect and preserve water quality because they will replace the original and incorrect data used in TMDL development, but will not result in a TMDL value change.

HOW TO COMMENT: DEQ accepts comments by e-mail, fax or postal mail. All comments must be in writing and be re-ceived by DEQ during the comment period. Written comments must include: 1) The names, mailing addresses and telephone numbers of the person commenting and of all people represented by the citizen. 2) If a public hearing is requested, the reason for holding a hearing, including associated concerns. 3) A brief, informal statement regarding the extent of the interest of the person commenting, including how the operation of the facility or activity affects the citizen. DEQ may hold a public hearing, including another comment period, if public response is significant and there are substantial, disputed issues relevant to the pro-posed permit. The public may review the draft permit and application at the DEQ office named below.
