In execution of a Deed of Trust from Emily Gross-Benjamin now known as Emily EvaMae Turtlewoman, dated January 10, 2014, in the original amount of $11,000.00 and recorded in the Clerk’s Office of the Circuit Court of Prince Edward County, Virginia, as Instrument NO. 201400047, default having occurred in the payment of interest and principal thereby secured, and at the request of the holder of the note secured thereby, the undersigned Trustee will offer the below described property for sale at public auction to the highest bidder for cash on Monday, December 21, 2015, at 10:00 A.M., on the front steps of the Prince Edward County Court House located on Main Street in the Town of Farmville, Virginia 23901, the said property being described as follows:

ALL THAT CERTAIN LOT, piece or parcel of land, with the buildings and improvements thereon, containing 2.6 acres, located on the North side of Virginia Secondary Highway Number 630, situate, lying and being in the Leigh Magisterial District, Prince Edward County, Virginia, and more clearly shown on that certain Plat made by D. L. Bowman, Land Surveyor, dated May, 1976 and recorded in the Clerk’s Office of the Circuit Court of Prince Edward County, Virginia, in Deed Book 226, at page 509. Said property is also described in that certain Deed recorded in the abovementioned Clerk’s Office in Deed Book 321, page 447. Reference to said Plat is hereby expressly given for a more complete and accurate description of the property hereby described.

BEING the same property conveyed to Emily Gross Benjamin, now known as Emily EvaMae Turtlewoman, (pursuant to an Order for Change of Name recorded in the above mentioned Clerk’s Office on July 6, 2010), by deed from James L. Whitlock and Joyce G. Whitlock, dated April 19, 2002, and recorded in the above mentioned Clerk’s Office as Instrument No. 200501346.

This is a communication from a debt collector.

The purchase price in the form of immediately available funds shall be due and payable on the closing date. A bidder’s deposit of ten percent (10%) of the amount of the sale will be required. The Trustee reserves the right to waive or modify the requirement with respect to the bidder’s deposit. The successful bidder will be required to close within thirty (30) days from the date of the sale. Time will be of the essence as to the closing date and the payment of purchase price.

The property will be sold “AS IS” and will be conveyed by special warranty deed, subject to all rights, reservations, easements and restrictions superior to the deed of trust as they may lawfully affect the property.
