Default having been made in the terms of a certain Deed of Trust dated March 22, 2013, in the original principal amount of $239,650.00 and recorded in the Clerk’s Office of the Circuit Court of the County of Buckingham, Virginia (the “Clerk’s Office”) in Deed Book 405, page 996, reformed in Case No. CL14-121 by Consent Order recorded in Deed Book 421, page 491, the undersigned Substitute Trustees will sell at public auction on August 27, 2015, at 9:30 a.m., on the steps in front of the Buckingham County Circuit Court, 13061 W. James Anderson Hwy., Buckingham, VA, the property designated as Parcel A: Containing 3.75 acres, more or less, lying northeast of, but not adjoining Virginia Secondary Route #740 (“RT 740”) and being described by a plat of survey dated December 16 & 25, 1978, and recorded in the Clerk’s Office in Deed Book 112, page 20. Together with a 20’ wide easement, for the purposes of ingress and egress, running from RT 740 in a northeasterly direction to said 3.75 acre parcel, said easement being depicted on the aforesaid plat as “20 ft. Outlet (R/W)”. Parcel B: Containing 5.754 acres, more or less, described as Lot 2 by a plat of survey dated 9/23/1994, and recorded in the Clerk’s Office in Deed Book 200, page 642. Subject to a perpetual, non-exclusive easement, for the purposes of ingress and egress, over a certain 30’ foot wide strip of land shown on the aforesaid plat as “30 ft. R/W to be Reserved by Deed”. Parcel C: Containing 1.92 acres, more or less, fronting on RT 740 and described as Lot 2 by a plat of survey dated 9/18/1995, revised 9/26/1995 and recorded in the Clerk’s Office in Deed Book 205, page 53. Parcel D: Containing 9.501 acres, more or less, described as the aggregate of: a parcel of 7.331 acres depicted by a plat of survey dated 8/13/2001 and recorded in the Clerk’s Office in Deed Book 268, page 160; and a parcel of 2.17 acres depicted as Parcel “A1” by plat of survey dated 7/18/2006, revised 6/12/2013, and recorded in the Clerk’s Office in Deed Book 408, page 687. Sale is subject to all prior liens, easements, restrictions, covenants, and conditions, if any, of record, or other matters which would be disclosed by an accurate survey or inspection of the premises. TERMS: CASH. A deposit of $23,000.00 or 10% of the sale price, whichever is lower, will be required of the successful bidder at time of sale. Prior to the sale, interested bidders will be required to register with and must present a bid deposit which may be held during the sale by the trustee. The bid deposit must be certified funds and/or cash, but no more than $9,900.00 of cash will be accepted. The successful bidder’s deposit will be retained at the sale and applied to the sale price. If held by the trustee, all other bid deposits will be returned to the unsuccessful bidders. Settlement is to be made within 15 days. The successful bidder will be responsible for obtaining possession of the property, and for all costs and fees related to recording the Trustee’s Deed, including the grantors tax. The successful bidder will be required to execute a Memorandum of Trustee’s Sale, available for review on the Foreclosure Sales page of www.glasserlaw.com, outlining additional terms of sale and settlement.
