In execution of a Deed of Trust from Jessie James Brown, aka, Jesse James Brown, and Phyllis L. Brown, dated July 23, 2001, in the original amount of $23,000.00, and recorded in the Clerk’s Office of the Circuit Court of Buckingham County, Virginia, in Deed Book 266, at Page 764, default having occurred in the payment of interest and principal thereby secured, and at the request of the holder of the note secured thereby, the undersigned Substitute Trustee (See the Designation of Substitute Trustee recorded in the above mentioned Clerk’s Office in Deed Book 402 at Page 755.) will offer the below described property for sale at public auction to the highest bidder for cash on Friday, September 11, 2015 at 10:30 A.M., at the front steps of the Buckingham County Courthouse located at 13061 W. Anderson Highway, Buckingham, Virginia 23921, the said property being described as follows:
ALL THAT CERTAIN TRACT, piece or parcel of land, with the buildings and improvements thereon, including one (1) 14’ X 70’ 1986 Clayton Mobile Home, situate, lying and being in Francisco Magisterial District, Buckingham County, Virginia, containing one (1) acre, more or less, bounded on the North by the lands, now or formerly, of Paul Senger, on the East and South by other lands, now or formerly, of Nannie B. Hartwell and on the West by U. S. Highway No. 15, said lands fronting on said Highway No. 15 for a distance of 100 feet and running back between parallel lines for a distance of 455 feet. The said Phyllis L. Brown departed this life intestate in the year 2009 and Jessie James Brown departed this life intestate March 2014. They were survived by their children Eddie Marvice Foster, Khalilah Denise Foster, Omark Tydell Foster, Jestina Lorrtell Brown and Jessica Loretta Brown.

The purchase price in the form of immediately available funds shall be due and payable on the closing date. A bidder’s deposit of ten percent (10%) of the amount of the sale will be required. The Trustee reserves the right to waive or modify the requirement with respect to the bidder’s deposit. The successful bidder will be required to close within thirty (30) days from the date of the sale. Time will be of the essence as to the closing date and the payment of purchase price.
The property will be sold “AS IS” and will be conveyed by special warranty deed, subject to all rights, reservations, easements and restrictions superior to the deed of trust as they may lawfully affect the property.
