In execution of a Deed of Trust in the original principal amount of $113,000.00, dated July 16, 2008 recorded in the Clerk's Office of the Circuit Court of the County Of Buckingham, Virginia, in Deed Book 362, at page 051, default having occurred in the payment of the Note thereby secured and at the request of the holder of said Note, the under signed Substitute Trustee will offer for sale at public auction at the entrance to the Buckingham County Circuit Court, Route 60, Buckingham, Virginia, on February 23, 2012 at 9:30 o'clock am the property described in said deed, located at the above address and briefly described as:

Parcel of land containing 12 acres, more or less, said lands being bounded on the southeast by lands now or formerly of Bradford, on the southwest by PARCEL TWO described hereinafter, and on the northwest and northeast by lands of S. W. Self, with improvements thereon, TOGETHER WITH a fifteen (15) foot wide right-of-way, to use as a means of ingress and egress, in the old road leading from Virginia Secondary Rt. # 701 to this parcel and

PARCEL TWO: Parcel of land containing 20.9 acres, more or less, said lands fronting and lying on both sides of Virginia Secondary Rt. # 701, and being bounded on the southwest by the lands of Slavet, on the west and northwest by the lands of S. W. Self, on the northeast by PARCEL ONE, and on the southeast by lands now or formerly of Bradford and lands now and formerly of Maxey, with improvements thereon, LESS AND EXCEPT: 2.00 acres off conveyed unto Taylor by deed dated August 4, 2006, and recorded in Deed Book 333, at page 605 et seq. and 0.125 of an acre also conveyed unto Taylor by deed dated October 1, 2007 and recorded in Deed Book 351, at page 686.

TERMS OF SALE: CASH: A deposit of $10,000.00, or 10% of the sales price, whichever is lower, cash or certified check, will be required at the time of sale with settlement within fifteen (15) days from the date of sale. Sale is subject to post sale confirmation that the borrower did not file for protection under the U.S. Bankruptcy Code prior to the sale, as well as to post-sale confirmation and audit of the status of the loan with the loan servicer including, but not limited to, determination of whether the borrower entered into any repayment agreement, reinstated or paid off the loan prior to the sale. In any such event, the sale shall be null and void, and the Purchaser's sole remedy, in law or equity, shall be the return of his deposit without interest.
