In execution of a certain deed of trust from Timothy Lee Cottrell and April S. Cottrell to Joseph D. Borgerding, Trustee, dated February 23, 2010, and recorded in the Clerk's Office of the Circuit Court of Amelia County, Virginia, in Deed Book 280, page 738, as Instrument Number 100000321, and in Prince Edward County, Virginia, as Instrument Number 201000306, securing a note in the amount of $102,555.00, default having been made in the payment of the debt therein secured and being required to do so by the noteholder, the undersigned Substitute Trustee, appointed by instrument recorded in the Amelia County Clerk's Office on December 7, 2011, as Instrument Number 201101708 and in the Prince Edward County Clerk's Office on December 19, 2011, as Instrument Number 201101962, will offer for sale at public auction the following:

ALL THAT CERTAIN tract or parcel of land situate, lying and being in both Leigh Magisterial District, Amelia County, Virginia, and Lockett Magisterial District, Prince Edward County, Virginia, containing 6.99 acres as shown on a plat of survey made by Todd M. Lenning, Land Surveyor, dated May 1, 2003, and recorded in Amelia County, Virginia, in Deed Book 270, page 9991 and recorded in the Clerk's Office of the Circuit Court of Prince Edward County, Virginia, as Instrument No. 200400900. Reference is hereby made to said plat for a more particular metes and bounds description as contained in said plat. The description contained in said plat is incorporated herein by reference as if same were textually herein contained.

BEING the same property conveyed to Timothy Lee Cottrell and April S. Cottrell, husband and wife, by deed from Todd M. Lenning and Wanda L. Lenning, husband and wife, dated September 26, 2006, and recorded in the Clerk's Office of the Circuit Court of Amelia County, Virginia, as Instrument #200602603 and recorded in the Clerk's Office of the Circuit Court of Prince Edward County, Virginia, as Instrument No. 200602765.

SALE TO BE HELD ON THURSDAY, FEBRUARY 16, 2012, AT 11:00 A.M. ON THE FRONT STEPS OF THE COURTHOUSE OF THE CIRCUIT COURT OF PRINCE EDWARD COUNTY, 124 NORTH MAIN STREET, FARMVILLE, VA 23901

TERMS OF SALE: Cash. Settlement within fifteen (15) days of sale, or as soon thereafter as a deed can be delivered. The property shall be sold “AS IS, WHERE IS” in its existing condition without warranties of any kind or character as to its condition or the use to which it may be put. Conveyance of the real estate shall be by special warranty deed. Sale shall also be subject to any additional announcements that may be made on the day of sale. A bidder's deposit of TEN (10) percent of the successful bid may be required.
