The object of this Complaint is partition of a parcel of land in Prince Edward County, Virginia, described as follows:
ALL that certain tract of real estate lying and being situated in Prince Edward County, Virginia, containing fifteen and seven tenths acres as per survey made by H.C. Dodl, which said tract of land is a balance of eighteen acres after two and three tenths acres have been sold to the Highway for road purposes.
The said tract of real estate is bounded as follows: on the East, now or formerly, by the estate of Watt Ligun; on the North, now or formerly, by the estate of Richard Woodson; on the West, now or formerly, by road leading from main highway to colored school house, and on the South, now or formerly, by the main Prospect Pamplin Highway, containing 15.7 acres, which is the balance of a tract of land Horace Adams conveyed to Margaret C. Glenn by deed dated September 28, 1927, which is of record in deed book 79, page 292; being the land of Louisa Lee returned delinquent and purchased by Margaret C. Glenn.
2.3 acres of this real estate is deducted from the 18 acres conveyed to said Margaret C. Glenn, and has been sold to the State Highway for highway purposes, in which Willie Johnson and Ella Johnson, his wife, released all of their rights in said 2.3 acres by virtue of a written contract between G. R. Glenn and themselves, and for further purpose of releasing a lis pendens heretofore filed in the clerk's office by the said Willie Johnson.
Such 15.7 acre parcel BEING the same parcel of real estate conveyed by deed dated the 3rd day of October, 1927, and recorded the 15th day of October, 1927, in deed book 79, page 319, Prince Edward County, Virginia, Circuit Court, by and between Margaret C. Glenn and George R. Glenn, her husband, grantors, and Willie Johnson, grantee.
LESS AND EXCEPT 2.3 acres conveyed pursuant to the deed recorded in deed book 79, page 330
LESS AND EXCEPT 6.5 acres conveyed pursuant to the deed recorded in deed book 93, page 302
LESS AND EXCEPT 1.53 acres conveyed by Annie Watson, Joan Early McCormick, Ella Early, Corine Johnson, Thomas McCormick and Mary Johnson, grantors, to Hunter Johnson, grantee, by deed of partition dated the 8th day of June, 1960, and recorded the 9th day of June, 1960, in deed book 144, page 107.
LESS AND EXCEPT 1.47 acres to the State Highway Commissioner by Order Confirming Commissioners' Report dated June 17, 1975, and recorded June 19, 1975, in deed book 195, page 171, and as referenced in the Certificate dated December 8, 1971 and recorded January 6, 1972, in deed book 179, page 243.
And upon plaintiffs' motion and supporting affidavit that the whereabouts of the heirs at law of Thomas A. McCormick, deceased, whose names, ages and residences are unknown.
It is ORDERED that the said heirs at law of Thomas A. McCormick, deceased, whose names, ages and residences are unknown, and anyone else who believes they may have an interest in the subject property, appear on or before the 30th day of March, 2011, at 10 a.m. in the Circuit Court for the County of Prince Edward and do what is necessary to protect their interests.
It is further ORDERED that his order be published once a week for four consecutive weeks in the following newspaper: The Farmville Herald.
